Terms & Conditions

Welcome to Mosey Terms and Conditions.

These Terms and Conditions (or “Terms”) govern your use of Mosey, except where we expressly state that separate terms (and not these) apply, and provide information about the Mosey Service (the “Service”), outlined below. When you create a Mosey account or use Mosey, you (a business hosting on Mosey, or a User) agree to these terms. 

 

If you have a “business account” or business subscription with Mosey, you can see your terms of use here.

If we show you sponsored posts or promotions, these Terms also govern how Mosey uses information to show you these posts that businesses pay us to promote. These Terms of Use therefore constitute an agreement between you and Mosey Limited.
 

1. The Mosey Service
 

We agree to provide you with the Mosey Service. The Service includes all of the Mosey features, applications, services, technologies, and software. The Service is made up of the following aspects:

1.1 The ability to find and locate foodservice businesses. Mosey’s primary mission is to help you locate food, sold from a range of businesses. The criteria for hosting a business account can be found here. You choose the filters for determining which businesses you wish to find, but Mosey may show you businesses that are relevant to you (such as showing a map of businesses close to your location).

 

1.2 Offering you opportunities to create, connect, communicate, discover and share. We do this through the information you provide to us, for example by posting to your page publicly or privately, or by creating a Mosey List publicly or privately. In some circumstances, we do this through information you have provided such as location settings to ensure you have the best possible experience. This ensures that when we show you sponsored posts, or services like trending Mosey Lists, they are of utmost relevance to you. 1.3 Booking and Reservations. Mosey offers you the ability to reserve a table in restaurants. To do this we use information you provide, such as date, time and number of persons to analyse our systems for availability. When you make a reservation, your data is passed to the foodservice business to ensure they can comply with and verify the booking.
 

1.4 Promoting safety, integrity and security on Mosey. We develop and use tools and offer resources to our community members that help to make their experiences positive and inclusive, including when we think they might need help. We also have human verification teams and systems that work to combat abuse and violations of our Terms and policies, as well as harmful and deceptive behaviour. Learn more about the restrictions we may impose on the use of Mosey, including information on how we apply our content policies and procedures in our Community Guidelines. Repeated violations of, or a severe violation of our Community Guidelines may result in termination of your account. Our Community Guidelines sets out how we may suspend access to Mosey where we determine that you have frequently provided manifestly illegal content, or suspend processing reports and complaints where we determine that you have frequently submitted manifestly unfounded reports or complaints. We use all the information we have - including your information - to try to keep our platform secure. We also may share information about misuse or harmful content with law enforcement.
 

1.5 Developing and using technologies that help us consistently serve Mosey users.
Organising and analysing information for the Mosey community is central to our Service. At times, we use technologies that help us personalise, protect, and improve our Service. Technologies like artificial intelligence and machine learning give us the power to apply complex processes across our Service, but help us ensure the functionality and integrity of our Service. 1.6 Communicating with you.
We may need to send you communications, like emails or in-app notices, to respond to you or inform you about any product-related issues, research, or our terms and policies. For more information, please review our Privacy Policy.
 

1.7 Ensuring access to our Service.
To operate our Service, we must store and transfer data across our systems around the world, including outside of your country of residence. The use of this global infrastructure is necessary and essential to provide our Service. This infrastructure may be owned or operated by Mosey or their affiliates. For more information about how we transfer, store or process your information, please review our Privacy Policy.
 

1.8 Connecting you with businesses, products, and services in ways you care about.
Subject to the choices and settings you select, we use information from Mosey, as well as from external partners, to personalise your experience on Mosey, including by showing you ads, offers and other sponsored content that we believe will be meaningful to you. And we try to make that content as relevant as possible. For more information about how we use information to provide you with a personalised experience, please review our Privacy Policy.
 

1.9 Providing and improving Mosey.
We use the information we have to develop, test, and improve our Service and collaborate with others on research to make our Service better and contribute to the well-being of our community. This includes analysing the information we have about our users and understanding how people use our Services, for example by conducting surveys and testing and troubleshooting new features.

2. How Our Service Is Funded

Mosey uses business subscriptions, sponsored posts, promotions, along with advertising to fund our Service.

2.1 If you choose to use our Service, you allow us to show you ads that businesses and organisations pay us to promote on and off Mosey.

2.2 If we show you ads on Mosey, we show you relevant and useful ads without telling advertisers who you are. We don't sell your information. We allow advertisers to tell us things such as the location of the audience that they want to see their ads (for example, people in Cork for a Cork sponsored post). We then show their ad to people who we think might find it relevant, i.e., people in Cork.

 

2.3 We also provide advertisers with reports about the performance of their ads to help them understand how people are interacting with their content on Mosey. For example, we provide general demographic and interest information to advertisers to help them better understand their audience. We don’t share information that directly identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are). 2.4 You may see branded content on Mosey posted by account holders who promote products or services based on a commercial relationship with the business partner mentioned in their content. You can learn more about this here.

2.5 You can learn about how we collect and use your information in our Privacy Policy, including more detail on the different types of information we can use to show you ads.
 

3. Business Regulations
 

3.1 Subscriptions & Recurring Payments

 

Where businesses opt to register for our paid profile option to avail of Mosey’s Booking features and capabilities, the business agrees to maintain a monthly payment to Mosey. If we are unable to collect payments for the registered subscription after repeated attempts, we reserve the right to place limitations on the account including but not limited to removing access to Booking capabilities and/or hiding the Business profile from public view. 3.2 Third Party Advertising

 

Mosey’s intended use is for businesses to promote their own foodservice business on our platform. We do not allow the use of our platform for the promotion, advertising, or marketing of products or services on behalf of third party businesses, advertisers or other social media or booking platforms without explicit written permission from Mosey.

 

3.3 Solicited Ratings & Reviews

 

Mosey values transparency and honest and authentic feedback. Businesses hosted on Mosey cannot engage in any form of manipulation of user ratings, reviews, or other feedback, This includes, but is not limited to, offering monetary compensation, discounts, rewards, or other incentives in exchange for positive ratings or reviews, biassed or misleading feedback, or the removal of negative ratings, reviews, or feedback without explicit written permission from Mosey.

3.4 Transparency & Due Diligence

Businesses should endeavour to ensure that all of their profile information including but not limited to opening hours and menu pricing up to date. In order to provide a fair and transparent search platform for customers, and in order to be fair to our other businesses that follow this rule, we may have to suspend businesses that fail to maintain accurate business details on their profile.

3.5 Customer Complaints

Complaints we receive from users that pertain to the performance or standards of a business hosted on Mosey will be directed to contact that business directly for resolution.

3.6 Cross Promotion

We do not allow promotion of other websites or services on our platform. Mosey business customers cannot promote in any circumstance unless it pertains directly to their foodservice business without explicit written permission from Mosey.

 

4. The Privacy Policy
 

Providing our Service requires collecting and using your information. The Privacy Policy explains how we collect, use, and share information across Mosey. It also explains the many ways you can control your information, including your Privacy and Security Settings.

5. Our Commitments
 

5.1 Mosey cannot and does not promise that any of the content generated by users or businesses:

5.1.1 Is accurate, complete and up-to-date

5.1.2 Does not infringe third party rights

5.1.3 Is legal

5.1.4 Or that it will not offend you.

 

5.2 You understand and agree that the content you may see on the platform does not represent our views and values and may not be suited to your purpose.

 

5.3 Mosey may contain links to third party websites, advertisements, services, offers or other events or activities that are not provided, owned or controlled by Mosey. We do not endorse these links or materials and you use them at your own risk.

 

5.4 Mosey makes its commitment to providing you the opportunity to discover foodservice businesses, but we cannot and do not guarantee the accuracy of business data or their details, such as food items, location, opening hours, allergen advice or any associated business information. We cannot guarantee the quality of food or the ratings of businesses and are not liable in any way for remedies that derive illnesses or health complications from a foodservice business, time spent at a business, or satisfaction levels.

 

5.5 Mosey is not liable for any injury, loss, claim, damage or any special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort, delict or otherwise, which arises out of or is in any way connected to a user’s visit to an affiliated hosted foodservice business. Mosey is neither an agent of, nor is connected with any hosted foodservice business.

 

5.6 In order to try and make our Services as trustworthy and accurate as possible, Mosey seeks verification from foodservice businesses and takes reasonable steps to validate them. We cannot guarantee that these measures will work every time, or that there won’t be instances of fraudulent businesses on the platform. 

If you suspect a business of being misleading, fraudulent, or purposefully violating our terms, please report it at support@moseyfoodfinder.com.

 

 

6. Warranties
 

6.1 The Services, all Mosey Content, and any other information, products, and materials contained in or accessed through the Services, are provided to you on an “as is” basis and without warranty of any kind. Mosey expressly disclaims all representations, warranties, conditions, or indemnities, express or implied, including, without limitation, any warranty of merchantability, fitness for a particular purpose, title or non-infringement, or any warranty arising from a course of dealing, performance, or trade usage. Mosey does not warrant that your use of the Services will be uninterrupted or error-free, that Mosey will review the information or materials made available through the Services for accuracy or that it will preserve or maintain any such information or materials without loss. Mosey shall not be liable for delays, interruptions, service failures, or other problems inherent in the use of the internet and electronic communications or other systems outside the reasonable control of Mosey.

 

6.2 The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights, however, the duration of statutorily required warranties, if any, shall be limited to the maximum extent permitted by law.

7. Release
 

Restaurants are solely responsible for their interactions with you and any and all claims, injuries, illnesses, damages, liabilities, and costs (“Claims”) suffered by you including without limitation interaction with or visit to any Restaurant or from any product or service of any Restaurant.

 

8. Your Commitments
 

In return for our commitment to provide the Service, we require you to make the below commitments to us:
 

8.1 Who Can Use Mosey
 

We want our Service to be as open and inclusive as possible, but we also want it to be safe, secure, and in accordance with the law. So, we need you to commit to a few restrictions in order to be part of the Mosey community.
 

8.1.1 You must be at least 13 years old.

 

8.1.2 You must not be prohibited from receiving any aspect of our Service under applicable laws or engaging in payments related Services if you are on an applicable denied party listing.

 

8.1.3 We must not have previously disabled your account for violation of law or any of our policies.

 

8.1.4 You must not be a convicted sex offender.

 

8.2 How You Can't Use Mosey

Providing a safe and open Service for a broad community requires that we all do our part.
 

8.2.1 You can’t use any robot, scraper, spider or other automatic or manual device, process, or means to access the Services of Mosey, or copy any Mosey content, without express written permission from Mosey.

 

8.2.2 You can’t take any action that imposes, or may impose, an unreasonable or a disproportionately large load on Mosey Services or infrastructure.

 

8.2.3 You can’t utilise any device, software or routine that will interfere or attempt to interfere with the functionality of the Services.

 

8.2.4 You can’t use any portion of the Services or Mosey Content, or incorporate any portion of the Services or Mosey Content into any product or service provided or owned by a third party.

 

8.2.5 You can't impersonate others or provide inaccurate information. You don't have to disclose your identity on Mosey, but you must provide us with accurate and up to date information (including registration information), which may include providing personal data. Also, you may not impersonate someone or something you aren't, and you can't create an account for someone else unless you have their express permission.

 

8.2.6 You can't do anything unlawful, misleading, or fraudulent or for an illegal or unauthorised purpose.

8.2.7 You can’t post misleading ratings, check-ins, posts or Mosey Lists.

 

8.2.8 You can’t make bookings with no express intention of turning up to those bookings (for example, reserving three businesses for the same time and date may lead us to thinking that you are not going to show up to one or more).

 

8.2.9 You commit to cancelling a reservation in advance, giving a business at least 30 minutes notice of the cancellation. For further information please see the Booking Agreements section (8.4).

 

8.2.10 You can't violate (or help or encourage others to violate) these Terms or our policies, including in particular the Mosey Community Guidelines. If you post branded content, you must comply with our Branded Content Guidelines. Report conduct or content in app under “Contact Us” or by email to support@moseyfoodfinder.com.

 

8.2.11 You can't do anything to interfere with or impair the intended operation of the Service. This includes misusing any reporting, dispute, or appeals channel, such as by making fraudulent or groundless reports or appeals.

 

8.2.12 You can't attempt to create accounts or access or collect information in unauthorised ways. This includes creating accounts or collecting information in an automated way without our express permission.

8.2.13 You can’t sell, licence, or purchase any account or data obtained from us or our Service. This includes attempts to buy, sell, or transfer any aspect of your account (including your username); solicit, collect, or use login credentials or badges of other users; or request or collect Mosey usernames, passwords, or business logins or passwords.

8.2.14 You can't post someone else’s private or confidential information without permission or do anything that violates someone else's rights, including intellectual property rights (e.g., copyright infringement, trademark infringement, counterfeit, or pirated goods). You may use someone else's works under exceptions or limitations to copyright and related rights under applicable law. You represent your own or have obtained all necessary rights to the content you post or share. 8.2.15 You can’t modify, translate, create derivative works of, or reverse engineer our products or their components.

 

8.2.16 You can't use a domain name or URL in your username without our prior written consent.

 

8.2.17 You can’t use Mosey’s chat feature to promote or solicit products, goods, or services unless they directly pertain to a foodservice business hosted on Mosey.

 

8.2.18 You can’t pay or exchange gifts in return for reviews, posts, or inclusion in Mosey Lists unless this is clearly and expressly declared within the caption or description of the relevant review, post, or Mosey List.

8. 3 Permissions You Give to Us

As part of our agreement, you also give us permissions that we need to provide the Service.

8.3.1 We do not claim ownership of your content, but you grant us a licence to use it.

Nothing is changing about your rights in your content. We do not claim ownership of your content that you post on or through the Service and you are free to share your content with anyone else, wherever you want. However, we need certain legal permissions from you (known as a “licence”) to provide the Service.

When you share, post, or upload content that is covered by intellectual property rights (like photos or videos) on or in connection with our Service, you hereby grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide licence to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings).

This licence will end when your content is deleted from our systems. You can delete content individually or all at once by deleting your account. To learn more about how we use information, and how to control or delete your content, review the Privacy Policy and visit the Mosey FAQ.
 

8.3.2 Permission to use your username, profile picture, and information about your relationships and actions with accounts, ads (if we show you ads), and sponsored content.

You give us permission to show your username, profile picture, and information about your actions (such as likes) or relationships (such as follows) next to or in connection with accounts, ads, offers, and other sponsored content that you follow or engage with that are displayed on Mosey, without any compensation to you.

For example, we may show that you liked a sponsored post created by a brand that has paid us to display its ads on Mosey. As with actions on other content and follows of other accounts, actions on sponsored content and follows of sponsored accounts can be seen only by people who have permission to see that content or follow.
 

8.3.3 You agree that we can download and install updates to the Service on your device.
 

8.4 Booking Agreements

8.4.1 Each business hosted on Mosey has the right to set their own booking policy. This may include instating a cancellation fee and/or a deposit requirement.

8.4.2 Each business has a right to determine their  required notice period for cancellations before a fee may be applicable.

 

8.4.3 Users may be required to provide card details when making a booking. This payment information is securely stored with our payments provider and the business will not have access to your card details. They may however process fees or charges against the card provided by you at booking where deemed applicable.

 

8.4.4 The Booking Agreement is solely between the User and the Business. Mosey claims no responsibility and will not get involved with disputes that pertain to a Booking Agreement.

 

8.4.5 The User agrees to the terms of the Booking Agreement set by the Business when the booking is placed.

 

9. Additional Rights We Retain
 

9.1 If you select a username or similar identifier for your account, we may change it if we believe it is appropriate or necessary (for example, if it infringes someone's intellectual property or impersonates another user).

 

9.2 If you use content covered by intellectual property rights that we have and make available in our Service (for example, images, designs, videos, or sounds we provide that you add to content you create or share), we retain all rights to our content (but not yours).

 

9.3 You can only use our intellectual property and trademarks or similar marks as expressly permitted by our Brand Guidelines.

 

9.4 You must obtain written permission from us or under an open source licence to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us.
 

10. Your Representations and Indemnity
 

10.1 You confirm that you own or otherwise control all of the rights to any User Content submitted by you; that all User Content submitted by you is accurate; and that exploitation of such User Content by Mosey and its other Users, partners, and licensees will not violate this Agreement, cause injury to any person or entity, or infringe any third-party rights.

 

10.2 You will indemnify Mosey and its managers, shareholders, officers, directors, employees, representatives and agents (collectively, the “Indemnitees”), against any loss, damage or cost incurred by us arising out of your use of Mosey. This includes, without limitation, the Services, the Mosey content or any other information accessible over or through Mosey, including information obtained from linked sites, any User Content submitted by you or your violation of this Agreement, our Privacy Notice or any other laws, regulations and rules.

 

10.3 You will also indemnify the Indemnitees against any claims that information or material which you have submitted to us is in violation of any law or in breach of any third party rights (including, but not limited to, claims in respect of defamation, invasion of privacy, breach of confidence, infringement of copyright or infringement of any other intellectual property right). We reserve the right to exclusively defend and control any claims arising from the above and any such indemnification matters and that you will fully cooperate with us in any such defences.

11. Account Details
 

11.1 To access the full functionality of our Services, you must create an account with us. When you create an account to access and use our Service, you must provide accurate and up-to-date information about yourself (such as your email and phone number. You agree to maintain and promptly update your details if they change. See our FAQ for information on opening an account.

 

11.2 It is important that you take reasonable steps to keep your account password confidential and that you do not disclose it to any third party. If you know or suspect that any third party knows your password or has accessed your account, please let us know straight away by our contact form or at support@moseyfoodfinder.com. You alone are responsible for ensuring no one has access to your account.

 

12. Content Removal and Disabling or Terminating Your Account
 

12.1 We can remove or restrict any content or information you share on the Service if we believe that it violates these Terms of Use, our policies (including our Mosey Community Guidelines), or we are required to do so by law. We can refuse to provide or stop providing all or part of the Service to you immediately to protect our community or services, or if you create risk or legal exposure for us, violate these Terms of Use or our policies (including our Mosey Community Guidelines), if you repeatedly infringe other people’s intellectual property rights, or where we are required to do so by law. We can also terminate or change the Service, remove or block content or information shared on our Service, or stop providing all or part of the Service if we determine that doing so is reasonably necessary to avoid or mitigate adverse legal or regulatory impacts on us.

 

12.2 In some cases when we remove content, we’ll let you know and explain any options you have to request another review, unless you seriously or repeatedly violate these Terms or if doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems, or products; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons.Learn more about our Complaints Handling Process here. If you believe your account has been terminated in error, or you want to disable or permanently delete your account, you can contact us at support@moseyfoodfinder.com.

 

12.3 When you request to delete content or your account, the deletion process will automatically begin no more than 30 days after your request. Content is removed immediately. After the content is deleted, it may take us up to another 90 days to remove it from backups and disaster recovery systems. Content will not be deleted within 90 days of the account deletion or content deletion process beginning in the following situations:
 

12.3.1 where your content has been used by others in accordance with this licence and they have not deleted it (in which case this licence will continue to apply until that content is deleted); or

12.3.2 where deletion within 90 days is not possible due to technical limitations of our systems, in which case, we will complete the deletion as soon as technically feasible; or

12.3.3 where deletion would restrict our ability to:

12.3.3.1 investigate or identify illegal activity or violations of our terms and policies (for example, to identify or investigate misuse of our products or systems);

12.3.3.2 protect the safety and security of our products, systems, and users;

12.3.3.3 comply with a legal obligation, such as the preservation of evidence; or

12.3.3.4 comply with a request of a judicial or administrative authority, law enforcement or a government agency;

12.3.2.4 in which case, the content will be retained for no longer than is necessary for the purposes for which it has been retained (the exact duration will vary on a case-by-case basis).

12.3.4 If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but this section and the section below called "Our Agreement and What Happens if We Disagree" (14)will still apply even after your account is terminated, disabled, or deleted.
 

13. Complaints Handling Process

At Mosey we value all forms of feedback and we strive to provide a safe and inclusive environment for all of our users. If you wish to make a complaint about the service, you can voice your concerns to us at support@moseyfoodfinder.com. They will be reviewed by a manager who will then aim to respond within 2 business days.

When submitting a complaint, please provide as much information as possible, such as who the complaint is directed at, the reason for the complaint, and the time and date that the issue occurred. 

When submitting a business complaint, please provide the business name and address along with the details of the complaint. 

 

When submitting a user complaint, please provide the user name or other identifying information such as a Mosey List name.

 

 

14. Our Agreement and What Happens if We Disagree
 

14.1 Our Agreement
 

14.1.1 Your use of music on the Service is also subject to our Music Guidelines. If you use certain other features or related services, you will be provided with an opportunity to agree to additional terms that will also become a part of our agreement. If any of those terms conflict with this agreement, those other terms will govern.
 

14.1.2 If any aspect of this agreement is unenforceable, the rest will remain in effect.

14.1.3 Any amendment or waiver to our agreement must be in writing and signed by us. If we fail to enforce any aspect of this agreement, it will not be a waiver.

 

14.1.4 We reserve all rights not expressly granted to you.

14.2 Who Has Rights Under this Agreement
 

14.2.1 This agreement does not give rights to any third parties.
 

14.2.2 You cannot transfer your rights or obligations under this agreement without our consent.

 

14.2.3 Our rights and obligations can be assigned to others. For example, this could occur if our ownership changes (as in a merger, acquisition, or sale of assets) or by law.
 

14.3 Who Is Responsible if Something Happens
 

14.3.1 We will use reasonable skill and care in providing our Service to you and in keeping a safe, secure, and error-free environment, but we cannot guarantee that our Service will always function without disruptions, delays, or imperfections. Provided we have acted with reasonable skill and care, we do not accept responsibility for: losses not caused by our breach of these Terms or otherwise by our acts; losses which are not reasonably foreseeable by you and us at the time of entering into these Terms; any offensive, inappropriate, obscene, unlawful, or otherwise objectionable content posted by others that you may encounter on our Service; and events beyond our reasonable control.
 

14.3.2 The above does not exclude or limit our liability for death, personal injury, or fraudulent misrepresentation caused by our negligence. It also does not exclude or limit our liability for any other things where the law does not permit us to do so.

14.4 How We Will Handle Disputes
 

14.4.1 If a claim or dispute arises out of or relates to your use of the Service as a consumer, both you and us agree that you may resolve your individual claim or dispute against us, and we may resolve our claim or dispute against you, in Irish court, and the laws of that country will apply without regard to conflict of law provisions.

 

14.4.2 If a claim or dispute arises between us that relates to use of the Service in any other capacity, including, but not limited to, access or use of the Service for a business or commercial purpose, you agree that any such claim or dispute must be resolved in a competent court in Ireland and that Irish law will apply without regard to conflict of law provisions.
 

14.5 Unsolicited Material

We always appreciate feedback or other suggestions, but may use them without any restrictions or obligation to compensate you for them, and are under no obligation to keep them confidential.

15. Updating These Terms

We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through our Service) within a reasonable timeframe before we make changes to these Terms and give you an opportunity to review them before they go into effect. We may ask you to “agree” or “accept” these Terms, but if you continue to use the Service, it will be taken as your agreement to these updated Terms and you will be bound by them. If you do not want to agree to these or any updated Terms, you can delete your account.
